BY CHECKING THE "I AGREE TO THE TERMS OF USE" CHECKBOX ON THE NETHUNTER WEBSITE (REGISTRATION AND TOOL PAGES), THE COMPANY YOU REPRESENT (THE "CUSTOMER") HEREBY AGREES TO THE FOLLOWING TERMS OF USE AND ALL TERMS INCORPORATED HEREIN BY EXPRESS REFERENCE (COLLECTIVELY REFERRED TO AS "TERMS").

 

1. Definitions

• "You", "Customer", "Subscriber" or "End User" refers to a natural person or a single legal entity, company, or other legal entity with legal personality that uses the Service (as defined below).

• "Terms of Use" or "Terms" refer to the terms under this Service Agreement.

• "Service" refers to the service offered by NetHunter.io, including all tools and features accessed through the web interface or API.

• "Service Infrastructure" refers to all NetHunter.io systems that enable, provide, or describe the "Service".

• "Network Security Audits" are audits conducted to verify the compliance of network devices with certain published security standards and to identify security vulnerabilities. They may include, among other things, port scanning and port connections, as well as the evaluation of services by checking versions and responses to specific requests.

• "Web Security Audits" refers to crawling a website to test forms or application responses or to confirm the presence of certain files.

• "Device" or "Devices" refers to computer hardware, network, storage, input/output, or electronic control devices or software installed on these devices.

• "Hostnames" refers to the name used to identify each device.

• "URLs" is the address of a website.

• "IPs" or "IP Addresses" refers to the address of a device.

• "Support" means the provision of technical assistance and remedies provided to the best of our knowledge and belief via a telematics means chosen by NetHunter.io.

• "Confidential Information" means all information disclosed by one party to another that is defined as confidential and proprietary under the terms of this Service Agreement.

• "Intellectual Property Rights" means all intellectual property rights, including patents, trademarks, design rights, copyrights, database rights, trade secrets, and all rights of equivalent nature worldwide.

 

2. Ineligible Parties

To the extent permitted by law, you are not eligible to subscribe to our services or act as a Bug Bounty Hunter for us if: (a) You or your employees have been convicted of computer or internet crimes; or (b) You are more than sixty (60) days overdue with funds or amounts owed to NetHunter.io; or (c) You are a competitor of NetHunter.io; or (d) You are located in a region where the use of the service is legally prohibited; or (e) You have previously been denied the service by NetHunter.io.

NetHunter.io reserves the right to deny access to potential subscribers of the service at its sole discretion if it deems such denial necessary.

 

3. Your Identity and Authority

You agree to provide current and accurate information in all electronic or printed registration forms submitted in connection with the service. You agree not to impersonate or misrepresent your affiliation or authority to act on behalf of any person, company, or other legal entity. By subscribing to the service or accepting these terms, all your employees who use the service or accept these terms confirm that they are authorized to act on your behalf and that they have been authorized by you as representatives of an individual, company, or other legal entity with contractual usage rights granted by an ISP or web host, owner, or license to use some or all IPs and associated devices to which you direct the service for execution. You agree to cooperate with NetHunter.io in reasonable measures to verify the identity and authority of persons using the service.

 

4. Prohibited Uses and Activities (Applicable to Customers and Bug Bounty Hunters)

A. Scanning networks, websites, applications, or similar of third parties without their consent, which must always be obtained by NetHunter.io.

You must never use or instruct the service to interact with IPs or devices for which you are not expressly authorized. You must not use the service in a manner that imposes an unreasonable burden on IPs or devices to which you direct the service for interaction. You must not use any service infrastructure directly or indirectly to initiate, propagate, participate in, direct, or attempt to hack or send bandwidth saturation, malicious, or potentially harmful network messages to any device, whether owned by NetHunter.io or not.

B. Appropriate Use of NetHunter.io Service

You must not cause an unreasonable burden on the service infrastructure through the use of the service or otherwise.

C. Illegal Activities

You must not use the service to conduct illegal activities, including but not limited to computer crime, transmission or storage of illegal content, or content or software that violates intellectual property and copyright laws.

D. Unauthorized Access

(i) You must not access information on the service infrastructure for which you are not authorized or that is not intentionally, publicly, and in accordance with NetHunter.io's privacy policy made available. If you gain access to information for which you are not authorized, by any means or methods or for any reason, you must immediately report this access to NetHunter.io and destroy all electronic or printed copies of this information. You must report incidents by email with a return receipt to [hello@NetHunter.io](mailto:hello@NetHunter.io).

(ii) Furthermore, you agree not to grant access to the service by: - a) allowing others to use your account; b) creating an account for a person who is not authorized to perform the role or view the information for which you have granted access; c) creating an account for an unauthorized party as defined in clause 2 above; or d) failing to revoke access for those persons who are no longer authorized to access the service for any reason. You will promptly notify NetHunter.io of any unauthorized access to your account or the accounts of others for which you have administrative authority, including the use of accounts, passwords, or other security breaches. You will not request the password of another party for any reason. You will not access another person's account or interfere with, disrupt, or restrict the functioning of the services or the use of the service by others.

(iii) To avoid confusion, no third party may access the service under the terms of this Service Agreement unless it is an express written authorization from Pentest Tools obtained from [technologypartners@NetHunter.io](mailto:technologypartners@NetHunter.io).

Any violation of the above agreements will result in the immediate termination of the service and, if necessary, referral to law enforcement authorities.

 

5. Support

Support will be provided to you via telematics means to assist you in the ongoing use of the service. Support is available during normal business hours (CET) at NetHunter.io. NetHunter.io may, at its sole discretion and without explanation of the service level, extend the availability of support to other time zones, if possible.

 

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS". NETHUNTER.IO DOES NOT WARRANT THAT THE ACTIVITIES AND FUNCTIONS CONTAINED IN THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN THE SERVICE WILL BE CORRECTED. NETHUNTER.IO HEREBY EXPRESSLY POINTS OUT THAT DISRUPTIONS TO THE TARGET SYSTEM MAY OCCUR DURING A PENETRATION TEST. THE CLIENT ACCEPTS THE RISK OF FAILURE OF THEIR TARGET SYSTEM WITH THESE TERMS AND CONDITIONS. NETHUNTER CANNOT BE HELD LIABLE FOR THIS UNDER ANY CIRCUMSTANCES, EXCEPT IN CASES OF GROSS NEGLIGENCE. FURTHERMORE, NETHUNTER.IO MAKES NO WARRANTY OR REPRESENTATION REGARDING THE USE OR RESULTS OF THE USE OF THE SERVICE OR THE DOCUMENTATION PROVIDED WITH IT IN TERMS OF THEIR ACCURACY, PRECISION, RELIABILITY, OR OTHERWISE. ORAL OR WRITTEN INFORMATION OR ADVICE FROM NETHUNTER.IO PARTIES DOES NOT CONSTITUTE A WARRANTY OR EXTEND THE SCOPE OF THIS WARRANTY IN ANY WAY. NETHUNTER.IO PARTIES MAKE NO OTHER EXPRESS, IMPLIED, OR STATUTORY REPRESENTATIONS, APPROVALS, WARRANTIES, OR GUARANTEES REGARDING THE SERVICE AND HEREBY EXPRESSLY DISCLAIM THEM, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR COMPLETENESS OF RESPONSES, RESULTS, PROFESSIONAL EFFORT, LACK OF VIRUSES, AND LACK OF NEGLIGENCE, AND THE PROVISION OR OMISSION OF SUPPORT. THERE IS NO WARRANTY OR CONDITION FOR OWNERSHIP, QUIET ENJOYMENT, QUIET POSSESSION, CONFORMITY TO DESCRIPTION, OR NON-INFRINGEMENT (OF INTELLECTUAL PROPERTY RIGHTS OR OTHERWISE) REGARDING THE SERVICE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, NETHUNTER.IO PARTIES SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY, INCLUDING OF GOOD FAITH OR REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER FINANCIAL OR OTHER LOSS) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR INABILITY TO USE THE SERVICE, THE PROVISION OR FAILURE TO PROVIDE SUPPORT, OR OTHERWISE UNDER OR IN CONNECTION WITH THIS SERVICE AGREEMENT, EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT, OR BREACH OF WARRANTY BY NETHUNTER.IO PARTIES, AND EVEN IF NETHUNTER.IO PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

7. Copyright and Intellectual Property

The service is protected by copyright and all other applicable laws and treaties protecting intellectual property in the United States and other nations, as well as all international treaties, unless expressly excluded herein. NetHunter.io parties own the title, copyright, and other intellectual property rights in the service.

This Service Agreement does not transfer any interest in or to the service to the subscriber, but only a limited right to use it, which is revocable under the terms of this Service Agreement. NetHunter.io parties own all rights, title, and interest in the service. No license or other right to the service is granted to the subscriber except for the rights expressly described in this Service Agreement. The subscriber hereby agrees to comply with all applicable laws and international treaties and agrees to notify NetHunter.io of any suspected infringement of NetHunter.io parties' intellectual property rights.

 

8. Privacy

You agree that NetHunter.io may collect and use technical information that you provide to us or that is acquired by NetHunter.io in the course of your use of the service. NetHunter.io agrees not to use this information in a form that personally identifies you. Each party must comply with their respective obligations under applicable data protection laws ("DPL").

You agree that NetHunter.io may refer to your company's name as one of its customers both internally and in externally published media unless you expressly and in writing restrict NetHunter.io from mentioning you. Any additional disclosure by NetHunter.io to you or your company requires your prior written consent.

 

9. Confidentiality

You acknowledge that the service and certain other materials provided herein are confidential. NetHunter.io confidential information of the parties includes all information related to the service and/or NetHunter.io businesses of the parties that are treated as confidential or secret by NetHunter.io parties (i.e., they are subject to efforts by NetHunter.io parties that are reasonable under the circumstances to maintain their secrecy), including but not limited to:

• The service;

• All other information disclosed to you by NetHunter.io orally, electronically, visually, or in a document or other material form that is either marked as confidential and/or proprietary or reasonably understood to be confidential and/or proprietary; and

• All notes, extracts, analyses, or materials created by you that are copies or derivative works of NetHunter.io parties' confidential information from which the content of such information can be derived or otherwise understood (the "confidential information").
   

During the provision of support, it is necessary for confidential information to be exchanged between you and NetHunter.io. The recipient may only use this confidential information for the purposes for which it was provided and may only disclose it to employees, contractors, or partners who are subject to similar confidentiality restrictions to the recipient and only for the purposes for which it was provided.

Confidential information does not include information that the recipient can demonstrate through written evidence:

• Was already lawfully known to the recipient without access to the confidential information or was independently developed by the recipient;

• Is disclosed in non-confidential published materials;

• Is generally known to the public; or

• Is lawfully received from third parties without any obligation of confidentiality.
   

The recipient agrees not to disclose confidential information to third parties and to protect and treat all confidential information with the highest care. Except as expressly provided in this Service Agreement, the recipient may not use or make copies of confidential information in whole or in part without the prior written consent of the other party. The recipient may disclose confidential information if required by laws, regulations, or orders of a competent court, provided that the recipient informs the other party in advance, discloses only the minimum information required for disclosure, and cooperates with the other party in taking appropriate protective measures. These obligations continue indefinitely even after the termination of this Service Agreement with respect to confidential information. NetHunter.io parties are not obligated to respect your confidential information in the event of termination due to a breach of the terms of the Service Agreement, provided that this information is necessary for NetHunter.io parties to protect their own rights and interests.

 

10. Changes to the Service

You acknowledge and agree that NetHunter.io may modify or remove the service as needed at its sole discretion. Scans, verifications, and authentications performed by the service may be modified, removed, or updated by NetHunter.io at any time without notice.

You hereby authorize NetHunter.io to conduct web and/or network security audits on all devices, IPs, hostnames, and URLs you specify. Web and/or network security audits are conducted with the assistance of NetHunter.io employees or contractors they engage and may include additional tests and validations from time to time that go beyond the scope of NetHunter.io's automated scanning system. In certain cases, the exploitation of a vulnerability and/or minimal extraction of data from the target server or web application may be conducted to support the results of NetHunter.io's security review or to illustrate a vulnerability to the customer.

 

11. Suspension of Accounts or Audits

NetHunter.io reserves the right to suspend the service provided to you at any time if it deems such suspension necessary at its sole discretion. NetHunter.io reserves the right to initiate or suspend an audit at any time if it deems it necessary at its sole discretion.

12. Storage of Scan Data

NetHunter.io is obligated to retain all stored data resulting from audits for a limited period of one (1) calendar year.

 

13. False Result Reporting

By submitting false results in the NetHunter.io logged interface, you allow us to manually investigate the issue based on your target or asset to improve the results of the respective tool for future scans. This grants us scan rights to your infrastructure, with the guarantee that we will not take any actions that endanger or compromise the asset in our attempts to reproduce the issue you described.

 

14. Beta Tests

If you receive the service for a limited period in the beta phase, this service is provided to you free of charge, at your own risk, without any warranty, "as is", without guarantees for the storage duration of audit data, and maintaining confidentiality as described in this Service Agreement, with the clear understanding that you are obligated to provide truthful, accurate, and complete feedback on the beta version of the service, without expectation of compensation, and you agree to waive any claims for royalties or other forms of compensation with NetHunter.io regarding the use of the provided feedback by NetHunter.io, in any form.

 

15. Indemnification

You agree to indemnify, defend, and hold harmless NetHunter.io parties from all claims, losses, demands, or damages, including reasonable attorney's fees, asserted by third parties due to your breach of any provision of this Service Agreement, your negligent or unlawful actions, and/or your violation of applicable laws.

 

16. Limitation of Liability

Notwithstanding any damages you may incur for any reason (including but not limited to all of the above damages and all direct or general damages), the entire liability of NetHunter.io parties under any provision of this Service Agreement and your exclusive remedy for all of the foregoing is limited to the amount you paid for the service, whichever is higher. during this calendar year or $5.00. The foregoing limitations, exclusions, and disclaimers apply to the maximum extent permitted by applicable law, even if a remedy fails of its essential purpose.

 

17. Term and Termination

Notwithstanding other rights, NetHunter.io may revoke this Service Agreement if you fail to comply with the terms of this Service Agreement.

An account that has reached its expiration date is considered terminated or revoked. If your account is terminated, you must immediately cease and desist from further use of the service.

 

18. Entire Agreement

This Service Agreement is the entire agreement between you and NetHunter.io regarding the service and support (if any) and supersedes all prior or contemporaneous oral or written communications, proposals, and representations regarding the service or other matters covered by this Service Agreement. To the extent that the terms of any NetHunter.io terms, policies, or programs for support conflict with the terms of this Service Agreement, the terms of this Service Agreement shall prevail.

Furthermore, the terms set forth in this Service Agreement shall prevail and control over any additional or conflicting terms or provisions contained in any document from you, whether set forth in a purchase order or an alternative agreement, and all such additional or conflicting terms are void and have no effect.

If this Service Agreement is translated into a language other than English and there are discrepancies between the translations, the English version shall prevail and be authoritative.

This Service Agreement:

• May not be assigned by you. Any purported assignment is null and void;

• May not be amended by you, but NetHunter.io may amend the Service Agreement from time to time and must incorporate any amended Service Agreement into the latest current version of the service available at [100](https://NetHunter.io) and may be made available upon request;

• Constitutes the entire agreement between the parties regarding the subject matter of this Service Agreement and supersedes all prior written and oral agreements, negotiations, and discussions between the parties regarding it; and;

• Is for the sole benefit of NetHunter.io and you, and nothing herein is expressly or impliedly intended to or shall confer any legal or equitable right, benefit, or remedy of any kind under or by reason of this Service Agreement on any other natural or legal person.

19. Severability Clause

If any part of a provision of this Service Agreement is found to be illegal, invalid, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it legal, valid, and enforceable, and all other terms shall remain in effect. Paragraph headings are for convenience only and have no effect or interpretation.

21. Governing Law

This service agreement is governed by and construed in accordance with the laws of Switzerland, Europe, without regard to conflict of law principles. You submit to the jurisdiction of a court located in Romania, Europe, for any claims or proceedings arising out of or related to this service agreement, and agree that all claims related to the action or proceeding may be heard and determined in such a court. There are no class actions, arbitrations, or lawsuits under this service agreement. NetHunter.io may seek injunctive relief in any location of their choice. You hereby submit to the personal jurisdiction of these courts. The parties expressly exclude the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act from this service agreement and any transactions between them that may be conducted in connection with this service agreement. The original of this service agreement was written in English. The parties waive all laws, statutes, or regulations that might provide for an alternative law or forum, or require this service agreement to be written in a language other than English.

22. Equitable Relief

It is agreed by NetHunter.io that due to the proprietary nature of the service, the remedies of the parties for a breach by you of your obligations under this service agreement are inadequate, and that NetHunter.io parties shall be entitled to equitable relief, including injunctive relief, without the posting of a bond and in addition to all other remedies available under this service agreement or at law, in the event of such a breach.

23. No Waiver or Delay

The delay or failure of NetHunter.io to exercise a right provided in this agreement does not constitute a waiver of that right. An express waiver, delay, or failure by NetHunter.io to exercise a right under this agreement promptly does not result in a permanent waiver or expectation of non-enforcement.

24. Force Majeure

A party is not liable under this service agreement for non-performance caused by events or conditions beyond that party's control, provided that the party makes reasonable efforts to perform. This provision does not relieve you of your obligation to make any payments due.
